Frage:

Wale sind Säugetiere und nicht Fisch. Sind sie halal? Da die Biologie sie nun klar als Säugetiere ausweist und nicht als Fisch, sie säugen ihre Jungtiere, wirkt sich das aus im Hinblick auf die Tatsache, dass unter den Meerestieren Fische klar als halal bezeichnete wurden? Beinhaltet das arabische Wort für Fisch die Säugetiere, die im Meer leben?

Antwort:

Es ist notwendig die Definition für Fisch auch für die Wale anzuwenden, dabei behält man jedoch die Definition der Zoologen im Hinterkopf. Wenn die Definition für Fisch auf sie zutrifft so gibt es kein Problem, obwohl es Säugetiere sind, und ihr verzehr ist halal. Die Definition für Fisch aus dem Zoologiebuch ist: ein Lebewesen mit Wirbelsäule, das ausschließlich im Wasser lebt und durch Kiemen atmet.
Nach Mufti Kifayatullah ist der Wal der „Anbar Fisch“ und er ist ohne Zeifel halal. (siehe dazu: Kifayat al-Mufti, vol. 9, pp. 134-137).

It is required to apply the definition of fish to the Whale keeping in mind the definition of fish described by the zoologists. If the definition of fish applies to it then there shall be no problem though it is mammal and it shall be lawful to eat it. The definition of fish as per the zoology books is: A creature with backbone that lives exclusively in water and breathes through gills.

As per the view of Mufti Kifayatullah sahib Whale is the Anbar fish and it is halal without any doubt. For detail, see: Kifayat al-Mufti, vol. 9, pp. 134-137)
